GENERAL WARRANTY CONDITIONS
Basic information
This warranty is granted by the distributor, Eurogama sp. z o.o. with its registered office in Warsaw, Aleje Jerozolimskie 200/225, 02-486 Warsaw, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XIV Economic Department of the National Court Register under the number 0000735164, NIP 5223128159, share capital 105 000,00 PLN, hereinafter referred to as the Guarantor.
The warranty covers physical defects of the Device resulting from improper workmanship of the Device or its parts, which make it unfit for its intended use.
Liability under the guarantee shall only cover defects arising from causes inherent in the Device existing at the time of issuance of the Device to the end user in the first retail sale.
The warranty is valid for 24 months for the first retail sale for non-professional and business use (consumer) and 12 months for the first retail sale for professional and business use (entrepreneur) from the date of issue of the Device to the end user.
The warranty is valid on the territory of the Republic of Poland for products purchased on the territory of the Republic of Poland.
The warranty does not cover:
1) mechanical damage, such as discoloration or abrasion of the external coating of the Device,
2) damages resulting from improper maintenance of the Device (chemical or thermal),
3) damage caused by interference of water or other liquid,
4) damage caused by using the Device inconsistently with the instructions attached to it,
5) damages caused by attempts to repair the Device by unauthorized service,
6) damage caused by modification or incorrect installation of software,
7) damage to parts subject to normal wear and tear, such as brushes, bags, filters, flexible tubes,
8) damage caused by lightning, surges, other disturbances in electrical networks,
9) damage caused by the occurrence of force majeure (i.e., for example, fire, earthquake, acts of war or other unforeseen external events).
In case of non-conformity of the Equipment with the contract, the entitled party shall have legal remedies at the side and expense of the Guarantor, and the guarantee granted shall not affect the possibility of availing of such remedies or their scope. In particular, this warranty does not exclude, limit or suspend rights under the non-conformity of the sold thing with the contract. Exercise of warranty rights does not affect the seller's liability for non-conformity of the sold thing with the contract. In the event of exercising rights under the warranty, the period for exercising rights for nonconformity of the sold thing with the contract shall be suspended as of the date of notification of the defect to the seller. The time limit continues to run from the date of the Guarantor's refusal to perform its obligations under the guarantee or the ineffective expiration of the time for their performance.
Warranty procedure
A proof of purchase (e.g. cash register receipt, invoice) is the document that entitles you to take advantage of the warranty.
When reporting a defect, contact the Guarantor through the Zelmer Authorized Service Center at 22 824 44 93 or via e-mail address: serwis@zelmer.pl or deliver the Device to the place of purchase (retail outlet). In the case of delivery of the Device to the place of purchase, the notification to the Authorized Zelmer Service is made by the retailer on behalf of the authorized person.
Shipment of the Device to the Zelmer Authorized Service Center shall be made through a courier service provider indicated by the Guarantor at the Guarantor's expense, after prior notification in accordance with Section 9 of the General Terms and Conditions of the Guarantee and obtaining a service request number (RMA).
The Eligible Person is obliged to make the Device available for collection by the Authorized Zelmer Service through the courier service provider indicated by the Guarantor. Otherwise, the cost of delivery of the Device and responsibility for damage caused in transit shall be borne by the authorized person.
The delivered Device should be complete. The Device should be accompanied by a description of the defect, a copy of the proof of purchase, the authorized person's return address and contact telephone number.
The Device should be prepared for transport in accordance with the requirements specified by the courier service provider indicated by the Guarantor. If the Device is not secured for transport in accordance with these requirements, the Guarantor shall not be responsible for damage in transit.
In case of damage to the Device during transport, it is recommended to draw up a damage report with a representative of the courier service provider indicated by the Guarantor.
The delivered Device should meet generally accepted standards of cleanliness, in particular, be delivered free of dirt and external contamination. Otherwise, the Guarantor shall have the right to refuse to repair the Device and return the Device at the authorized party's expense.
Upon delivery of the Device to the Zelmer Authorized Service Center, defects revealed during the warranty period will be removed by the Guarantor.
The Guarantor is obliged to respond to information about the defect within 14 days from the date of its notification to the Zelmer Authorized Service Center.
Defects of the Device revealed during the warranty period will be removed as soon as possible, from 14 to 21 working days from the date of delivery of the Device to Zelmer Authorized Service Center.
If the defect found by the Authorized Zelmer Service Center cannot be repaired, the authorized party shall have the right to replace the Device with a new one free of charge. The replacement shall be carried out by the Zelmer Authorized Service Center.
If it is not possible to replace the Device with a new one, the eligible person is entitled to a refund of the funds for the purchase of the Device. After the warranty period has expired, the Zelmer Authorized Service Center may perform warranty repair against payment. The cost of repair is determined individually depending on the possibility and complexity of the repair.
